WHEN FRAUD HITS: HANDLING CIVIL FRAUD CLAIMS IN AUSTRALIA

The ACCC has reported that in 2017, more than $340 million was lost by victims of fraud in Australia.

This figure is likely to be significantly higher if it included other dishonesty based civil claims, such as:

  • breach of fiduciary duties by directors;

  • claims of deceit;

  • fraud by misrepresentation; and

  • wrongful and fraudulent trading and secret commissions, to name just a few.

We have recently been acting for claimants and defendants in fraud-related claims, often involving trust entities and which have multi-jurisdictional elements.  Please download our publication for some matters to consider if you suspect fraud in your business or personal affairs.
